General terme of Sale
- SUBJECT OF CONTRACT
These general conditions have as their object the purchase of products or services through remotely via telematic network from Petit Prince srl, registered office in Via San Leone n. 3/B - 80054 Gragnano (NA). In particular every purchase operation will be governed by the provision the Italian Civil code and Italian Legislative Decree n. 206/ 2005 ( Consumer Code) at the Section II ( Distance Contracts) for the protection of personal data from the provision Legislative Decree, 30th June 2003, n. 196.
- PURCHASE ORDER AND CONTRACT COMPLETION
The contract is concluded upon receipt by the Supplier of the purchase order for the selected products and / or services sent by the Customer on the website www.petitprinceart.com. The sending of the electronic purchase order implies the full knowledge, by the Customer, of these General and Payment Conditions and their acceptance. The Customer declares to have read all the information provided to him during the purchase procedure. If the Customer is a consumer (i.e. a natural person acting for purposes unrelated to business, commercial, craft or professional activity), once the purchase procedure has been completed, he will print or save an electronic copy or otherwise keep these conditions of sale also in compliance with the provisions of art. 52 and 53 of Legislative Decree 206/2005 on distance contracts. Any right of the Customer to compensation for damages or compensation is expressly excluded, as well as any contractual or extra-contractual liability for damages, direct or indirect to persons and / or things, deriving from the non-acceptance, even partial, of an order.
- PURCHASE METHOD
Purchases of products and services for sale on the website www.petitprinceart.com are made at the price indicated therein, to be confirmed at the time of order confirmation, in addition to shipping fees.Before confirming the purchase, the total cost of each product or service chosen, the total cost and transport costs will be summarized.
- PRICES AND PAYMENT
The payment of the price of the services and products purchased and the costs of the relative transport must be made according to the methods chosen when ordering: CREDIT CARD - PAYPAL - ADVANCE BANK TRANSFER.
- DELIVERY OF PRODUCTS AND SHIPPING COSTS
The delivery of the products will be carried out in the following ways chosen by the customer: - Free collection by the customer at the headquarters of Petit Prince srl, in via Castellammare n. 197, 80054 Gragnano (NA), or at the Pinacoteca del Piccolo Principe in Piazza Duomo n. 11, 84010 - Ravello (SA). - Express Courier - Delivery will be made to the address indicated by the Customer for shipping. The customer is required to verify that the package is intact, not damaged or wet. Only after this verification will the Customer have to accept the delivery. Once the delivery has been accepted, if the contents inside the package are damaged, the Customer will have 24 hours from the date of delivery to contact Petit Prince srl and request a refund of the insurance, sending photographs showing the damage in a clear way.
- PROCESSING TIMES OF AN ORDER
The processing days indicated in the product data sheets are indicative, but in no case are considered mandatory. However, it will be the responsibility of the Supplier Company to process the orders as soon as possible, compatibly with the times of realization of the products or the performance of the services acquired. The Company will not be responsible for any delays by national couriers, attributable to external causes or force majeure. In this regard, the Customer declares to have been informed that the timing for the fulfillment of an order varies according to the type of processing and the quantity requested. If the customer has purchased a service, it will be his responsibility to send the necessary material to allow the Company to carry out the service. The list of this material is specified in the product sheet of the service. The Company cannot process the service until the material is sent in its entirety exclusively in the manner illustrated in the service sheet.
- RIGHT OF WITHDRAWAL
The Customer has the right to withdraw from the contract concluded with the seller, without any penalty and without specifying the reason, within ten (10) working days, starting from the day of receipt of the products purchased on www.petitprinceart.com. To exercise the right of withdrawal, the Customer must send an email to info@petitprinceart.com and wait for the return form that will be sent to the Customer by email. Only when the customer has received the form will he be able to send the return. In no case will returns be accepted without the explicit request by the Customer and without sending the return form by the Company. The Customer assumes the costs and risk of transporting the return. Once the return has arrived at our warehouse, in via Castellammare n. 197 - 80054 - Gragnano (NA), the company will issue the refund within 10 working days
If the customer has purchased a service, he cannot exercise the right of withdrawal in the following cases:
- if he has sent the requested material incomplete;
- as regards the Furnish your Shop service;
- as regards the Furnish your Studio service;
- if you are not satisfied with the proposals sent by the Company.
Furthermore, it cannot request the replacement of one or more proposals.
- JURISDICTION
For all disputes concerning the interpretation of the execution of the contracts, the competent Court will be esclusively the Court of Torre Annunziata (NA)
